Aged Dependent Relative Visa (Subclass 114 & 838)

Permanent support for an elderly, single relative.

The Aged Dependent Relative Visa allows an older person who is financially dependent on an eligible relative in Australia to migrate permanently and live in Australia indefinitely. There are two subclasses:

  • Subclass 114 — for applicants living overseas at time of application and grant.
  • Subclass 838 — for applicants already in Australia (on a valid visa) when applying and at grant.

Both are permanent visas — successful applicants gain full permanent residency rights.

Who Can Apply?

To qualify as the aged dependent relative, you must meet all of the following:

  • Be financially dependent on an eligible relative in Australia (relying on them for basic needs: food, shelter, clothing) — or be unable to work due to disability.
  • Have been dependent for at least 3 continuous years before lodging the application.
  • Be of pension age (or age eligible for age pension under relevant Social Security laws at time of application).
  • Have no spouse or de facto partner — you must be single.
  • Meet standard health and character requirements.
  • Have no outstanding debts to the Australian Government (unless a formal repayment arrangement is in place).

Sponsor Requirements

Your sponsor must be:

  • An Australian citizen, permanent resident or eligible New Zealand citizen.
  • Aged 18 or over and settled in Australia.
  • Willing to provide sponsorship, including accommodation and financial support, to you for at least the first 2 years after you arrive.
  • Able to provide an Assurance of Support (AoS) — a legally binding guarantee that ensures you do not rely on government welfare for the initial period.

What This Visa Gives You

If granted, the Aged Dependent Relative Visa provides:

  • Permanent residency in Australia — you can live, work and study indefinitely.
  • Access to public health (Medicare), and other social benefits available to permanent residents.
  • Travel rights — typically a 5‑year travel facility after grant; thereafter you can apply for a Resident Return Visa (RRV) or citizenship (if eligible).
  • Option to include certain dependent family members (children/step‑children) in your application — if they meet eligibility criteria.
